Guidance on submitting asbestos demolition/renovation notification forms.

  • What kind of problems or errors on an Asbestos Demolition/Renovation Notification would make the notification incomplete?

    The following are some of the more common issues seen on the notification form that would make the submittal incomplete:

    1. In Section II, if the notification is being submitted as a notification of both a renovation and a demolition, then both “Renovation” and” Demolition” boxes must be checked.
    2. In Section II, both Renovation and Demolition are checked, but there are no dates for the demolition in Section IV. (left blank or indicated as “TBD”) and no “Demolition Contractor Information” in Section VII (left blank or indicated as “TBD”).  
      1. *Note that in this situation, if all the required information is included for the abatement, then the notification will be considered complete for that part of the project; however, it would be considered incomplete for the demolition part of the project. A complete notification for demolition must be submitted to NHDES at least 10 working days before the start of demolition. 
    3. In Section IV, one or more of the following are missing: 
      1. Name or certification number for the expected Asbestos Supervisor for an abatement project.
      2. Name for the Asbestos Inspector, the date of inspection, or the means used to determine whether asbestos containing materials is present.
      3. Start or end dates (left blank or indicated as “TBD”) for the abatement or demolition.
      4. Days or times indicated for the work schedule. 
      5. Amount of asbestos containing material (ACM), type of ACM, whether the ACM is friable or not, or location of ACM being removed are not indicated.
    4. In Section X, there is no original signature of the individual submitting the notification and certifying its accuracy.
    5. For notifications of transport and disposal of asbestos containing material, one or more of the following are missing:
      1. In Section II, the box for Transport & Disposal is checked, but there is no date indicated in that section for when it occurred. 
      2. There is no quantity of asbestos containing material being disposed of in Section IV.
      3. There is no transporter information in Section VIII.
      4. There is no disposal location information in Section IX.
  • Is a fee required when submitting an Asbestos Demolition/Renovation Notification?

    It depends on the type of notification.  

    $50, for asbestos abatement projects where the amount of regulated asbestos-containing material (RACM) that will be disturbed is more than 10 linear feet, 25 square feet, or 3 cubic feet, but less than 260 linear feet, 160 square feet, or 35 cubic feet. 

    $300, for asbestos abatement projects where the amount of RACM that will be disturbed is equal to or greater than 260 linear feet, 160 square feet, or 35 cubic feet. 

    No fee for a demolition project where no RACM will be abated.

    No fee for a transporting and disposing of asbestos containing material from an asbestos abatement project not requiring notification.

  • How is the fee for the notification to be paid?

    Cash (if the notification is hand-delivered), company check, certified check, or money order. A company check, certified check or money order must be made payable to “Treasurer, State of New Hampshire.”

  • What do I do when I determine that the amounts of asbestos that were included in a previously submitted Asbestos Renovation/Demolition Notification have changed?

    Please be advised that EPA, under 40 CFR §61.145(b)(2), requires the owner or operator to update the notification, ”as necessary, including when the amount of asbestos affected changes by at least 20 percent.” Therefore, although not specified in Env-A 1800, NHDES requires that the owner or operator submit a revised notification to NHDES if the amount of asbestos affected changes by at least 20% to comply with 40 CFR §61.145(b)(2). Since 40 CFR §61.145 does not require notification fees, then the owner or operator would only be subject to the $25 revision fee if the revised notification involves a start date change, a completion date change, or a break in operation.

  • How do I complete an Asbestos Renovation/Demolition Notification for a phased project?

    For a phased project, the owner or operator should submit an initial notification that includes the start and end date of the entire project (i.e., includes all the phases). The owner or operator should also attach to that notification the start and end dates of each phase of the project.

  • How do I notify NHDES of changes to the dates of one or more phases of a phased project, which were previously submitted to NHDES in an Asbestos Renovation/Demolition Notification?

    If the start date or end date of the entire project or a phase changes from the initial notification or there is a break in asbestos abatement activities that was not included in the initial notification, then the owner or operator should submit a revised notification to reflect the changes and the revised notification fee of $25.

How and when to submit a Revised Asbestos Abatement Notification
  • When does a revised Asbestos Renovation/Demolition Notification have to be submitted to NHDES?

    A revised notification for a change to the start date must be received by NHDES prior to the start date in the original or most recently revised notification, whichever is earlier, or prior to the original completion date in the event of an extension or overrun. Note that a revised notification with a revised start date that is earlier than the original start date must comply with a 10-working day waiting period from the date of submittal of the revised notification date.

  • How do I submit a revision to a notification?

    NHDES must be notified, preferably by email, although notification by fax or telephone are allowed, within 24 hours prior to the change in date(s) or interrupting the operation. A paper copy of the revised notification must be sent or delivered to NHDES within one business day by first-class USPS mail, commercial delivery service, or hand delivery.

  • What is the fee for submitting a revised notification?

    $25 in the form of cash, company check, certified check, or money order. A company check, certified check or money order shall be made payable to “Treasurer, State of New Hampshire."

  • What if I am unable to submit the revised notification to NHDES within the allowed times as described above?

    If the revised notification is not submitted to NHDES prior to the previously notified start or end date, as described above, then any changes to the dates in the initial notification must be submitted in a new abatement notification, with the applicable notification fee of $300 or $50 depending on the amount of regulated asbestos containing material. Please note that the new abatement notification must be submitted in paper format by mail or hand delivery and is subject to a new 10 working day waiting period.

  • Are there any exceptions to having to begin a new 10-day waiting period when revised notification is not submitted on time? 

    The only exception to the new waiting period would be where a change to the previously notified start date for the abatement project meets the criteria for emergency asbestos abatement as specified in Env-A 1802.22. In that case, you must follow the requirements for notification of an emergency asbestos abatement specified in Env-A 1804.05, including the submittal of a new written notification and fee to NHDES no later than 48 hours after beginning the emergency asbestos abatement.
