New Hampshire National Pollutant Discharge Elimination System Study Commission
A legislative commission to study whether NHDES should administer the National Pollution Discharge Elimination System.

Background
Section 402 of the Clean Water Act is the National Pollutant Discharge Elimination System (NPDES) permitting program. NH is one of four states not delegated to administer the NPDES Program. NHDES reviews and certifies that the federal permit issued by the US Environmental Protection Agency (EPA) meets the NH water quality standards and provides limited outreach on the federal stormwater program but does not have statutory authority to issue stormwater permits.

Project
Overview The Commission is to determine whether NHDES should request delegation of the National Pollutant Discharge Elimination System from the EPA, and if so, to recommend a fee structure that would pay for the department to hire the required number of employees to manage the issuance of permits and administer the program.
