Underground Storage Tank Program
Underground Storage Tank Facility Permit to Operate

Purpose
To minimize land and water contamination by ensuring that underground storage tank facility owners achieve and maintain compliance with applicable regulations, and that they cease operation if compliance cannot be maintained.

Applicability
Applies to owners of all underground storage tank (UST) facilities having an individual tank capacity greater than 110 gallons or of unknown size that store a regulated substance. Does not apply to owners of non-residential heating oil USTs not larger than 1,100 gallons and all residential heating oil USTs.

Application
No application. Permits are issued upon finding that the facility is in compliance with applicable regulations through facility inspection and file review.

Fee
None.

Processing Time
Typically one week after the design review and construction approval process is complete.

Term/Renewal
The permit does not terminate as long as the facility is in compliance with applicable regulatory requirements.

Modification/Amendments
None.

Transferability
Any transfer of ownership must be reported within 10 days to the Underground Storage Tank Program. Please contact the Oil Remediation and Compliance Bureau at (603) 271-3899 or orcb.wmd@des.nh.gov for more information on underground storage tank related forms.

Appeals
Any person aggrieved by a final decision can appeal to the Waste Management Council in accordance with RSA 21-0:9
