What are the requirements to mitigate by payment into the Aquatic Resource Mitigation (ARM) Fund?

Projects requiring mitigation may be eligible for payment into the ARM Fund with the following exceptions. The project"s proposed impacts cannot exceed one acre, except for public roadway and utility projects which cannot three acres of impact and must meet the criteria for the NH programmatic general permit.

For an applicant to be eligible to provide an ARM fund payment, the other mitigation options must be reviewed and considered. The applicant would have the choice to mitigate by providing an ARM fund payment, if no practicable local mitigation opportunities exist or payment is environmentally preferable. Documentation must be provided that explains why wetland restoration, preservation of upland buffer, or wetland creation is not viable.
